========

Many thanks your above mentioned letter, which we read with interest.

First of all, we would like to thank you for taking your time in replying to us, which (must admit) a rare thing for the past 6 (six) months we started to raise the issue in such tenure.

Our position is that we are asking "How is the weather!" and the reply of ParisMOU secretariat (that you explain in the last para of your letter) is "we are fine, thanks and how are you !!"

Yes, all of our letters follows detention of a Turkish controlled ship in a ParisMOU member state, but the focal point is not, if that "particular" Turkish controlled ship gets detained on the right grounds or not. No one can judge discrimination this way. You need to have other examples to compare with, in order to see if there is discrimination or not. Thus, following each detention of Turkish controlled tonnage, we give examples from EU controlled tonnage

getting inspected (or not..) in similar/close settings . .

there is a good chance to compare with . . SUCH AS ,

THE ONES BELOW

==============

2345-gt Malta-flagged (but Turkish controlled) cargo M/V Reina 1 (IMO: 8802478) collided with 10870-gt Turk flagged ferry M/V Ankara in the Adriatic Sea on Oct 20. Vessel Reina 1 sunk immediately and at least three sailors were killed. Five sailors are still missing. No casualties on board vessel Ankara. The cause of the collision is still under investigation.

Ankara is on time-charter and working on Durres/Bari daily ferry route together with her sister vessel from the same Turkish shipowning interests.

Ankara (following SAR operation) continues her voyage and arrives her destination (BARI)Where she got detained by Italian Port State (ParisMOU) Authorities. We do not know yet,on what grounds she got detained, since it is not made public yet, but we, under any circumstances, donot intend/wish to argue if she is detained on the right grounds or not.

However, we would like to remind you that ANKARA passed 2 port state control inspections without being detained, both in BARI-ITALY during the past 3 months (11 July & 08 September 2011 tobe exact).

OKAY, NOW LETS SEE HOW THE DETENTION OF THAT TURKISH FLAG

FERRY COMPARES WITH :

CONDOR VITESSE; 5000 gross (350dwt) 1997 built Bahamas (UK Mirror) flag, Den Norske Veritas class, HSV (high speed ferryboat) under UK Management working

Channel Islands & St.Malo-France route.

On 28 March 2011, CONDOR VITESSE, under thick fog sailing at 37knots (and not reducing her speed due to adverse weather) and (against the rules of COLREG) not sounding fog-signals (because master claims it is distracting the attention of deck officers at watch !! and engine-noise of the HSV should be good enuff..) hit a french fishingboat kiling her french master immediately and while 2 fishermen survives on the still flooting aft part of the boat that got broken into 2.

The official accident report by French Auth. Was just made public on 18 October 2011 and can be downloaded (110 pages both in French and also in English) in the following link :

http://www.beamer-france.org/BanqueDocument/pdf_290.pdf

In the report, you will notice that the officers at watch, just before the accident, was in a lively discussion on the film CATWOMAN and not giving any attention to the plots

on the radar (showing the fishingboat)

NOW, YOU WILL ASK “ WHAT IS THE POINT ???” , RIGHT !!

THE POINT IS, “CONDOR VITESSE” FLYING BAHAMAS FLAG, NOT BEEN INSPECTED BY THE PORT STATE CONTROL IN ST.MALO-FRANCE, FOLLOWING THIS FATAL ACCIDENT. . .

LET ALONE, SHE BEING DETAINED, SHE HAS NOT EVEN BEEN INSPECTED BY PSC !!!!!

IF YOU STILL DID NOT GET, WHAT WE MEAN, WE WILL GIVE IT TO YOU ::

CESME-EXPRESS, a Turkish flagged 120 gross small day passenger boat, serving the one daily one-hour route of Cesme-Turkey/Greek Island Across “Chios”, got detained by the Port State Control at Chios Greece for 12 days (10-21 October 2011)

For you to understand, from what kind of a SHIP we are talking about,Please kindly check the photo of that boat in Chios-Greece on 15 October 2011 (still under PSC detention)

http://www.marinetraffic.com/ais/showallphotos.aspx?imo=8982694

Now, lets please see what are the 21 deficiencies, 6 of which found grounds for that small day passenger boats”detention (YES”s)

OKAY, HOW IS “THAT” TURKISH DETENTION COMPARES WTH,

“CONDOR VITESSE” NOT EVEN GETTING INSPECTED !!!

I SEE, YOU STILL CAN NOT DRAW PARALELS . .

THAN WE WILL GIVE YOU ONE MORE EXAMPLE, THIS TIME FROM “TOKYO-MOU” (or INDIAN OCEAN MOU, same thing, since AUSTRALIA is member to both of them...)

On 21 October 2011, A danish maritime forum published following video of an accident dated 8 October 2010, recorded by the security cams of the Port Tilbury/Australia.

http://www.maritimedanmark.dk/?Id=12158

GRAND RODOSSI, 1990built, Liberian flag, Bureau Veritas classed,

Panamax (68.000 mt carrying capacity) bulk carrier, managed by GREEK Company, hits and sinks the large oceangoing tunafishing boat berthed at that Port.

And after this accident, On 10 October 2011, Port State Control boards this vessel and she DOES N O T GET DETAINED.

Here is a copy of that pity PSC result:

http://212.45.16.136/isss/public_apcis.php?Action=searchInspByID&Skip=0&InspID=00544360

OKAY, THAT PANAMAX BULKER WAS SOLD TO HER PRESENT GREEK OWNING

INTERESTS ON NOVEMBER 2004, BY HER TURKISH OWNERS MESSRS,DENAK ISTANBUL AND SHE IS EX. MEHMET BEY.

SO THE QUESTION HERE IS : IF SHE WAS STILL “MEHMET BEY” UNDER TURK CONTROL, MAKING THAT TERRIBLE ACCIDENT IN PORT LINCOLN-AUSTRALIA,

WOULD SHE GET DETAINED BY PSC THERE OR NOT ????

WHAT ARE THE ODDS ????

++

One last striking example, to see how it compares . .

Just one year old Turkish controlled chemical tanker LIDO imo 9447328 , 2010 built (in Turkey, in the Owners”Shipyard), 18.000dwat, Malta flag, B.V. class, all flag certificates & ISM docs by Bureau Veritas.

Which is on Charter to "BP Oil –CASTELLON/Spain".

She was detained in the port of CASTELLON/Spain, on 21-26 September 2011 With 6 deficiencies, ALL 6 DEFICIENCIES ARE FOUND AS GROUNDS FOR HER DETENTION , among which we find

Especially one of them unique “09128 - Provisions quantity Insufficient ”

NOW, HOW IS THAT COMPARES WITH:

MAERSK ADVANCER, imo 9254381, 2004 built, Isle of MAN (UK Mirrow) flag, Lloyds Register class,6536gross Offshore Supply Ship, managed by Danish “Maersk Supply AS”

Please note her latest ParisMOU PSC inspection in LAS PALMAS-SPAIN on 14 February 2011 when she passed WITHOUT BEING DETAINED, BUT WITH SINGLE DEFICIENCY, WHICH IS :

- Ship Certificates 01106 -

Document of Compliance (DoC/ ISM) : Missing

Ground for Detention :: NO !!!!

HOW IS THAT POSSIBLE !!!! . . A SHIP MISSING DOC PASSING A PSC WITHOUT BEING DETAINED IS UNHEARD IN THE HISTORY OF SHIPPING !!!

During the past weeks, its all over Danish media that Statoil is calling Maersk Supply to an emergency safety meeting, because the intern letters of Maersk Supply is circulating

in the media, accusing management for not furbishing the 70 strong supply fleet with necessary supplies and ships are manned with incompetent crew etc etc, and there are

serious accidents on board, people are dying etc etc, and because of the EVEN THE FLAG STATE, ISLE OF MAN, AT A TIME (which probably same time as “Maersk Advancer” got

inspected at Las Palmas-Spain, when DOC was missing....) WAS THREATENING TO (maybe even did !!) WITHDRAW THE MAERSK SUPPLY AS”S DOC !!! In anycase, Maersk Supply A/S got a MAJOR NON-CONFORMITY with an EXTERNAL ISM AUDIT by ISLE OF MAN REGISTRY . .

Here is the article in DANISH :

http://www.business.dk/transport/statoil-sikkerhed-afgoerende-for-kontrakter

Also please kindly read all the previous articles in this respect, Where links are given at the end of above page, after “LAES OGSA” (meaning ALSO READ) this will definitely give better insight

You can translate it with :

THERE IS NO DISCRIMINATION, IF ALL NATIONS” SHIPOWNING INTERESTS ARE TREATED THE SAME WAY BY PORT STATES.

FROM THE EXAMPLE, WE MENTIONED ABOVE (AND WE HAVE MANY MANY MORE ON DAILY BASIS), DO YOU GET THE NOTION OF FAIR-PLAY ???

BECAUSE W E D O N O T . . . .

AND THIS NEEDS TO CHANGE

Thus, we thank your letter but regret to let you know that your letter has N O T addressed the points we raising.

EUROPEAN COMMISSION

DIRECTORATE-GENERAL FOR MOBILITY AND TRANSPORT

Directorate D - Logistics, maritime & land transport

D.2 - Maritime safety

Brussels, 24 OCT. 2011

MOVE/D.2/JPBD(2011)

Subject: Your e-mails regarding the detention of Turkish-controlled vessels following Port State Control inspections

Dear Mr Erenler,

I refer to the e-mails that you have addressed to several public authorities including the European Commission regarding the detention by national administrations in certain Paris MoU Member States of Turkish-controlled vessels and more specifically to your emails entitled:

1. "Detention of Turkish controlled dry cargo coaster mv"XXXXX"

(ref Ares (2011)992029 - 20/09/2011)

2. "Detention of Turkish controlled dry cargo coaster mv“XXXXX”

(Ref. Ares (2011)991967 - 20/09/2011)

3. "Detention of Turkish controlled coaster mv "XXXXX"

(Ref. Ares (2011)991956 - 20/09/2011)

In your e-mails you mention a large number of vessels, ports and states but the essential message appears to be that you are of the view that Turkish-controlled vessels are treated

in a discriminatory manner by the maritime administrations of Paris MoU Member states.

As you state that you are a member of the Turkish Chamber of Shipping and so as to avoid repeated and unnecessary e-mail correspondence I understand that the Paris MOU Secretariat has written to the Turkish Chamber of Shipping on II July 2011 regarding your e-mails and the allegations contained therein.

I understand that the Paris MoU Secretariat has explained the Port State Control review panel mechanism and has suggested to the Chamber that if one of the Chamber's members is unhappy with a Port State Control decision that this case can be brought to the Detention Review Panel through the flag State or the recognized organization concerned. The Secretariat has also requested that these complaints be taken through the

appropriate channels.

I trust that this letter has addressed the points you raised.
